Introduction
The Constitution of the Republic of Kosovo, which entered into force on June 15, 2008, reflects guarantees that are also important for ensuring the conformity of individual’s rights in relation to citizenship, its acquisition and preservation. It is important to note that Article 14 of the Constitution specifically stipulates that the acquisition and loss of citizenship of the Republic of Kosovo are regulated by Law. On the basis of Article 14 of the Constitution of Kosovo, the Law on Citizenship of Kosovo was enacted, which governs the principles, procedures, criteria and requirements of acquiring and losing the citizenship of Kosovo. The Law on Citizenship of Kosovo has defined the concept of citizenship, emphasizing that it denotes the close legal bond between the state of Kosovo and a person, giving rise to mutual rights and obligations. In order to establish such a bond between the state of Kosovo and a person, the Law on Citizenship has outlined specific procedures, criteria, and requirements that pave the way for obtaining the Kosovo citizenship. The execution of such legal procedures is intertwined with provisions from other laws of Kosovo, whose implementation facilitates and supports the implementation of the Law on Citizenship of Kosovo. In the Republic of Kosovo, the full implementation of legislation regarding citizenship is complex due to the legal situations defined in different laws that may not always be harmonized among themselves. Such legal situations will be addressed and resolved within this paper by analyzing and interpreting in other laws the legal concepts not clarified in the Law on Citizenship, aiming at a more accurate and fair implementation of the provisions of the Law on Citizenship of Kosovo. Thus, on the one hand, it will be easier to predict and implement the procedures, requirements and criteria that enable the acquisition of Kosovo citizenship by interested persons, while on the other hand, upholding the individual’s basic constitutional and universal right, such as the right to obtain citizenship.
